Legislative Measures for the Introduction of Commuting Accidents in the Industrial Accident Compensation Insurance Act in Korea

Abstract
This study aims to search for legislative measures to introduce commuting accidents in the Industrial Accident Compensation Insurance Act. Judging from the characteristics of both Korean industrial accident compensation insurance and commuting accidents, it would be appropriate to introduce a compensation system which separates commuting accidents from industrial accidents. To approve a commuting accident as eligible, the process and the way, on which a accident happens, must correspond to the definition of the commutation and must be a cause of the accident. Lower level of the compensation compared to industrial accidents is not desirable, but low level of co-payment for medical service from the insured could be considered. The benefit entitlement should be suspended in intentional accidents and the cash benefit in accidents from gross negligence can be limited, considered by both benefit appropriateness and financial burden. The contribution must be paid by the employer, but the employee can bear a fraction of medical cost symbolically. It is important to find a simple and reasonable way to realize the liabilities of car insurance companies because car accidents are the most often and expensive cause of commuting accidents.
